Minute of the Richland County Board of Adjustments Committee Meeting

Thursday, July 01, 2010

 

Item # 1           The Chairman Sebranek called the meeting to order at 1:00 p.m. Those present were Larry Sebranek, Allen Rippchen, Gilman Moe, Tom McGlynn, Harriet Pedley, Ralph Bailey, Kevin Bailey, and Cheryl Dull.

 

Item #2            Pedley stated she posted the agenda in the Richland Observer for two weeks and on the bulletin board in the courthouse. Motion by Moe, seconded by Rippchien to approve the publication and agenda. Motion carried.

 

Item #3            Sebranek asked if there were any additions or corrections to the June 3, 2010 meeting minutes.  Hearing none, the chair approved them as mailed.

Item #4            The board heard a petition of Ralph and Kevin Bailey to request a variance to the Land Division Ordinance required width of an easement being sixty-six feet (66) wide to thirty-five (35) feet wide in Section 31 of Willow Township. The want to split their land between themselves and the configuration of the two lots means that one brother will have to grant an entrance easement to the other.  The existing driveway enters on the County Hwy NN and is 35 feet in width.  This existing driveway will be the easement.  Presently there is a creek on one side of the driveway and a spring on the other where it meets the county road which restricts the ability to widen it to sixty six feet.  The Township provided a letter that they have no problems with the request. Pedley reported that the following neighbors contacted the office and stated that they had no problem with their request:  David Teiwes, Mary Lou Hanold Steven Post.  One neighbor, Leo Procknow, called and stated he was against the variance request because he believes the Bailey brothers plan on further subdividing their property and more land owners would be using the easement to enter onto County Hwy NN.

 

Gilman Moe stated he wanted to abstain from the vote because he is the Willow Township Chairman. Motion by Rippchien, seconded by McGlynn to approve the variance request after all the members reviewed the packet of information which contains the three criteria demonstration, maps, photos and application.  Motion carried. 

 

Item # 5           The Jones were not in attendance to present their petition to request a variance to the required parcel size of 5 acres in the Agriculture/Residential zoning district to 4 acres in Section 28 of Marshall Township.

Motion by Rippchien, seconded by Moe to table the request.  Motion carried.

 

Item # 6           No report.

 

Item # 7           Next meeting to be August 5th at 1:00 pm. Motion to adjourn by Sebranek, second by McGlynn. Motion carried.
