Minute of the Richland County Board of Adjustments Committee Meeting

Thursday, August 5, 2010

 

Item # 1          The Vice Chairman McGlynn called the meeting to order at 1:00 pm. Those present or who signed up to speak were Tom McGlynn, Randy Heims, Allen Rippchen, Gilly Moe, Ryan Elliott, Ken Hanson, Bill Seep and Cheryl Dull.

 

Item #2           Dull stated the agenda had been posted the in the Richland Observer for two weeks and on the bulletin board in the courthouse. Motion by Moe, seconded by Heims to approve the publication and agenda. Motion carried.

 

Item #3           McGlynn asked if there were any additions or corrections to the July 1, 2010 meeting minutes.  Hearing none, the Vice Chair approved them as mailed.

 

Start of Public Hearing 1:01 pm.

 

Item #4           The board heard a petition of Ryan Elliott and Jessica Tolle, Section 10, Westford Township, to request a variance to the requirement of a minimum of 2 acres in a Residential 2 district to 1.06 acres. Dull told the committee that a CSM was completed in 1991 although it was not rezoned at the time. There have been 2 appraisals done with the first one missing the illegal zoning and the second one caught the zoning problem. If it had been rezoned when the CSM was done it would have been a legal size. It was approved at the August 2 zoning meeting contingent on the BOA variance request. Bill Seep is here from the Westford Township board to speak in favor of the variance. No other neighbors heard from.

 

Motion by Gilman Moe, seconded by Allen Rippchen to approve the variance request after all the members reviewed the packet of information which contains maps, photos and application. Motion carried.

 

Item #5           Motion by Randy Heims, seconded by Allen Rippchen to bring back off the table the petition for Merlin Jones, Section 28, Marshall Township. The board heard the petition of Merlin & Jeffery Jones, Kenny Hanson is here to speak for the Jones. The buyer is requesting a variance to the minimum requirement of 5 acres in an Ag/F district to 4 acres. When the property was list for sale and during the appraisal the property was discovered to be illegally zoned. The buyers want to have a couple of farm animals. It was approved at the July 1 zoning meeting contingent on the BOA variance request. We have received approval from the township board. No neighbors were heard from.

 

Motion by Allen Rippchen, seconded by Randy Heims to approve the variance request after all the members reviewed the packet of information which contains maps, photos and application. Motion carried.

 

Item # 6          The Zoning Administrator is not present to report anything. Cheryl Dull did advise the board that Harriet Pedley did report that she is retiring as of July 1, 2011.

 

Item #7           Next meeting will be September 2 although there are no petitions filed at this time. Motion to adjourn at 1:11 pm by Allen Rippchen, second by Randy Heims. Motion carried.
