Zoning Committee Meeting Minutes

February 18, 2010

 

Item #1            The meeting was called to order by Chairman Rasmussen at 9:00 a.m.  Those present were Richard Rasmussen, Marilyn Marshall, Virginia Wiedenfeld, Carol Clausius, Bob Holets, Ann Greenheck and Harriet Pedley.

 

Item #2            Motion by Holets, seconded by Marshall to approve the agenda and publication.  Motion carried.

 

Item #3            Motion by Marshall, seconded by Wiedenfeld to approve the minutes of the February 1, 2010 meeting.  Motion carried.

 

Item #5            The most current correspondence from Herbeck was previously given to the committee members.  In the letter dated February 8, 2010, Herbeck stated he would be removing his horses from his commercially zoned property in Buena Vista Township.  Discussion followed and it was the consensus of the committee members that a letter be sent to Mr. Herbeck giving him until April 1, 2010 to get the horses removed from the property.

 

Item #4            Pedley provided the committee with a draft of the proposed changes to the Agriculture and Forestry zoning district to encompass the new Chapter 91 statute.  The changes to the draft are as follows:

1.      C. General Agricultural and Forestry District (A-F)

In purpose first paragraph last sentence should read “Land being rezoned out of this district shall occur only if the town and county find the following:”

2.      Move C. A. 2. Agriculture-related uses to the conditional use section

3.      C. A. 3. d. Accessory uses – insert – “A business activity or enterprise whether or not associated with an agricultural use that is conducted by the owner or operator of a farm.  Additional accessory building(s) shall not exceed a total of 1,500 square feet of floor area and shall not convert prime farmland from agricultural use or convert land previously used as cropland, other than a woodlot, from agricultural use or significantly impair or limit the current or future agricultural use of other protected farmland.  No outside storage of stock in trade or vehicles, or other items related to the business, activity, or enterprise is permitted excepting those vehicles incidental to the principal use of the property.”

4.      C. A. 3 e.  Last sentence leave in – “If the party living in the manufactured home no longer works on the farm, the manufactured home shall be removed from the premises.”

A vote was taken on this item with Rasmussen and Wiedenfeld voting no and Holets, Clausius and Marshall voting yes.

5.      C. A. 5. Exclude any language except “Prior Nonconforming Uses”

6.      C. A. 8. Exclude any language except “Community and other living arrangements per 59.69 (15).

7.      C. B.  – Beginning paragraph shall read as follows – “Before granting a conditional use permit in the Agriculture and Forestry Zoning District, the County shall require comment from the Town Board and/or Planning Commission of the town affected town prior to any issuance of said conditional use permit”.

8.      C. B. 1. (c). remove the word “reasonably”.

9.      C. B. 1. (d). remove the word “substantially”.

10.  C. B. 7. (c). remove the word “reasonably”.

11.  C. B. 7. (d). remove the word “substantially”.

12.  C. B. 8. (c). remove the word “reasonably”.

13.  C. B. 8. (d). remove the word “substantially”.

14.  C. B. 10. – increase the distance to 2,640 (˝ mile)

15.  C. B. 16. 1. - Lots not served by public sanitary sewer - Minimum of 2 acres in lot area.

16.  C. B. 16. 5. Omit number 5

 

Pedley will number the draft to conform to the existing ordinance and continue on with the process of making application to DATCP for recertification.  She explained to the committee that they have up to 90 days to accept or reject the recertification request.  A copy of the original draft and a copy of the final amendments will be attached to these minutes.

 

Item#7 Motion by Clausius, seconded by Marshall to adjourn until March 1, 2010 at 9:30.  Motion carried.
