Zoning Committee Meeting Minutes

April 5, 2010

 

#1  The meeting was called to order by Chairman Rasmussen at 9:30 a.m.  Those present were Richard Rasmussen, Marilyn Marshall, Virginia Wiedenfeld, Carol Clausius, Bob Holets, Harriet Pedley, Warren Pfeil and Mike Nelson.

 

#2  Motion by Clausius, seconded by Marshall to approve the agenda and publication.

 

#3  Motion by Holets, seconded by Wiedenfield to approve the minutes of the March 1, 2010 meeting minutes.  Motion carried.

 

#4  The committee heard the petition of Mike Nelson to rezone 3.19 acres from Agriculture/Forestry to Residential-2 in Section 4 of Marshall Township.  Pedley stated that this property is being sold to Mr. Nelson’s daughter and the bank had requested an appraisal from John Bomkamp.  It was discovered that this parcel was created in 1986 when William Nelson sold to Mike Nelson (father/son).  Marshall Township adopted zoning in 1982 therefore this parcel is  illegally zoned.  Pedley stated that no neighbors were heard from and a letter of approval was received from Marshall Township.  Motion by Holets, seconded by Marshall to approve the rezoning request and pass it to the next available county board session.  Motion carried.

 

#5  Pedley went over the 2009 Annual Report with the committee.  It will be presented at the April county board session.

 

#6  Pedley will meet with Ben Southwick today and go over the application for an ordinance amendment concerning Working Lands Initiative.  Pedley will then send the application in with all required signatures.  The Department of Agriculture will have 90 days to accept or deny our request.

 

#7  Pedley explained about the NR115 rule that went into effect on February 1, 2010.  All counties in the state have two years to adopt the new rule.  The Department of Natural Resources is providing the counties with grant money to defray the cost of amending the ordinance.  The base amount of the grant is $5,000.00 and can go higher if the county can show evidence of additional costs.  Pedley stated that she would like to see some mapping done of the navigable streams in the county and that we would need additional help from MSA to do the project.  She suggested that the county could probably apply for additional dollars above the $5,000 but no proposals have been given to date.  Motion by Holets, seconded by Wiedenfeld to approve the application for a grant from the DNR for ordinance formulation in access of the base amount.  Motion carried.

 

#8  Pedley stated that the horses have been removed from the Herbeck property.  She is also working with the District Attorney’s office on a junk yard along Hwy 131 north of Viola.

 

#9  Pedley reported that there are 226 septic maintenance forms that have not been returned.  She will be working with the District Attorney’s office to bring those homeowners into compliance with the requirement of maintaining their septic systems.

 

#10  Motion by Clausius, seconded by Marshall to adjourn until May 3, 2010 at 9:30 a.m.  Motion carried.
