Minute of the Richland County Zoning Committee Meeting

Monday, June 07, 2010

 

Item # 1          The Zoning committee meeting was called to order by Chairman Rasmussen at 9:00 am. Those present or who signed up to speak were Todd Fischer, Jim Lewis, Marilyn Marshall, Virginia Wiedenfeld, Gaylord Deets, Bob Holets, Richard Rasmussen, Richard Powers, Paul Deckert, Teresa Deckert, Harriet, and Cheryl Dull taking minutes..

 

Item #2           Motion by Marshall, seconded by Holets, to approve the publication and amended agenda. Motion carried.

 

Item #3           Moved by Rasmussen to declare the minutes approved as presented.

 

Item #4           Motion to approve the Land Committee minutes by Lewis, seconded by Deets. Motion carried.

 

                                                Start of Public Hearing 9:30 am.

 

Item #6           The committee heard a petition from Paul & Theres Deckert to rezone 5 acres from Agriculture and Forestry to Agriculture/Residential in Section 19 of Dayton Township.

Pedley stated that she had received a phone call from Dayton Township stating the rezoning request had been approved by the town.  No letter was sent.    

Discussion: Paul Deckert stated they are selling off the house and 5 acres and retaining the remaining 38 acres say that is all the land the buyers were interested in purchasing.  Pedley stated no neighbors were heard from.

 

Motion by Wiedenfeld, seconded by Holets to approve the petition and pass it to the next county board session in June. Motion carried.

 

Item # 7          The committee heard a petition from Richard & Diane Powers to rezone 2 acres from Agriculture and Forestry to Residential-2 in Section 19 of Orion Township.  Pedley stated that the Town of Orion had submitted their approval by letter which is part of the packet.  Pedley stated that this property, owned by Powers, is in the Managed Forest Law but when they became a part of the program they left out 2 acres for the intended home.  Powers stated that after they built the home and moved in, Diane Powers did not like country living.  There is a problem with the lot since there was a shed built on it a few years ago that would be too big for the Agriculture and Residential zoning district.  Because of this, Powers went to the Board of Adjustment and asked and received a variance to the size of the existing shed.  There is no size limit in the Agriculture/Forestry zoning district. 

Ron Ewing, a neighbor, called and stated as long as he is not building a new shed he does not have a problem.

 

Moved by Deets, seconded by Marshall to approve the petition and pass it to the next county board session in June. Motion carried.

 

Item # 8          The committee heard a petition from the City of Richland Center to rezone 8.2 acres from Agriculture and Forestry to Industrial in Section 7 of Buena Vista Township and obtain a Conditional Use Permit for a wastewater treatment facility.  Buena Vista has approved the request. 

Discussion: Rasmussen has a concern of how close the project is to the Pine River. Since last year, Foremost Dairies made a proposal to the City concerning a system that would pretreat the dairy waste at the site and then send it over to the city’s facility for final treatment.  The original plan would have made the building closer to County Hwy TB. The City did not want any structures to stand out in the rural community so they proposed a new site behind the other structures.  With the change to the plans it does not move anything any closer to the Pine River than originally planned. Fisher explained without this change there would be no room for expansion. These newly added silos would discharge to the treatment plant not to the Pine River. The distance to the front fence to County Hwy TB is 1,080 feet. If the rezoning request is approved, they will move toward the river by 210 feet. There is an agreement set up with the townships on the visual barriers. There will also be a committee set up of neighbors concerning input to the visibility of the structure. All retention ponds are on the zoned areas. The Waste Water treatment plant will be responsible for repair to the surface of the road. The County will be responsible for maintaining the road and upgrades to the design of the road. Holets stated he would like to see the retention pond area to stay Agriculture and Forestry zoning district.   Holets also stated he wanted less acres rezoned.

 

Pedley reported there were no neighbors heard from.

 

Motion by Wiedenfeld, seconded by Lewis to approve the petition with was opposed. Marilyn, Roll call vote results were Marshall, Rasmussen, Lewis, Deets and Wiedenfeld voting in favor and Holets voting against.  Motion carried.

 

The committee heard a petition from the City of Richland Center for a Conditional Use permit for a conditionals use permit to place a wastewater treatment facility on 8.2 acres in Section 7 of Buena

Motion by Holets, seconded by Marshall to approve the conditional uses placed on the previous conditional use permit application in December of 2009.  Motion carried.

 

Item # 9          Pedley handed out a plan the Land Records Committee office members have been working on. The deadline to submit is October. Todd Halverson from MSA needs to address some of the language and some final details are to be completed. This will be on the agenda again at a later date.

 

Item # 9          Pedley has received a four page letter from the Department of Agriculture, Trade and Consumer Protection asking for several changes of which Pedley did change. After review from the committee Pedley was instructed to make the necessary revisions and resend them to the department for review. Motion by Wiedenfeld, seconded by Marshall, to resend the text amendments with revisions to DATCP for their approval. Motion carried.

 

Item # 10        None

 

Item # 11        Pedley has tried to contact Mr. Herbeck. He is not returning her calls or responded to the letters. Motion by Holets, seconded by Marshall to send the violation to Southwick, county attorney. Motion carried.

 

Item # 13        The public access computer in Land Records needs to be replaced. It has died several times. The electronic fund must go before the County Board to be spending money out of that fund. Motion by Wiedenfeld seconded by Holets to purchase a new compute. r Motion carried.

 

Item #12         Pedley has requested an extension of her vacation for 6 months. Motion by Wiedenfeld, seconded by Holets to approve the extension. Motion carried.

 

Item #14         Nothing to report

 

Item #14         There is a bill to Ayres and Associates for $10,000 for the aerial photography. Motion by Wiedenfeld, seconded by Holets to send on to the next appropriate committee for approval.   Motion carried.

 

Item #15         Next meeting is set for July 8 at 1:00. Motion to adjourn by Marshall, seconded by Lewis. Motion carried.
