Richland County Board of Adjustment Hearing Minutes

March 6, 2008

 

Item #1            Vice-Chairman McGlynn called the meeting to order at 1:00 p.m.  Those present were Tom McGlynn, Randy Heims, Gilman Moe, Allen Rippchen, Marvin Buroker, Harriet Pedley, Larry and Carol Stirsman, and Todd Muckler representing the Stirsman as their designer. 

 

Item #2            Motion by Rippchen, seconded by Moe to approve the agenda and publication.  Pedley stated that the notice was in the Richland Observer for two weeks and posted on the bulletin board on the first floor of the courthouse.

 

Item #3            Motion by Heims, seconded by Rippchen to approve the minutes of January 3, 2008 as mailed.

Motion carried.

 

Item #4            The board heard a variance request from Larry and Carol Stirsman to request a variance of 13 feet to the required setback of 70 feet from the centerline of Gies Lane in Section 6 of Dayton Township.  Muckler, speaking on behalf of the Stirsman’s, explained to the board members that the Stirsman’s would like to remove their existing home on Gies Lane and salvage the existing foundation and place a new home with additions, including a garage.  It is the attached garage that does not meet the setback requirement of 70 feet from the centerline of the town road.  He stated the house is on the end of a dead end road (Gies Lane).  He stated that they had attended the Dayton Township monthly meeting where the variance was discussed and approved.  The township made the statement that they do not have any plans to extend Gies Lane and even with the approval of the variance, they would still have plenty of room for the township trucks to turn around.  Muckler stated that the Stirsman’s did not have a choice with the placement of the house and garage since there is floodplain to the west of their property along the entrance on Gies Lane, their septic system to the east, a heavy slope to the south and the property line to the north that prevented them from complying with the ordinance.  He also asked the board members if they would consider a greater variance that the petition calls for since they have not been able to locate the corner markers of the property to see if it is really 57 feet from the centerline of Gies Lane or not.  He stated that a variance request of 55 feet would definitely be sufficient.  The board discussed this request.  All the board members agreed that an additional 2 feet of variance request would not make a great deal of difference in this situation.  Motion by Moe, 2nd by Buroker to approve a variance of 15 feet (or 55 feet) to the required setback of 70 feet to the centerline of Gies Lane.  All members voted in favor of the request for the same reasons mentioned above.  Motion carried. 

 

Item #5            Pedley explained to the board members that there is a training session coming up for Boards of Adjustment in Baraboo the end of this month.  She read the agenda items for this meeting and stated that the county would pay to send them if anyone is interested.  One of the board members inquired how soon the zoning office would have to know.  Pedley answered that the sooner the better, although even a last minute application would probably be OK.  The county will pay for any attending fees and per diem costs. 

 

Motion by Heims, seconded by Rippchen to adjourn the meeting at 1:30 p.m.  The next scheduled meeting is April 3, 2008 at 1:00 p.m.
