Richland County Board of Adjustments Meeting Minutes

August 6, 2009

 

Item #1            The meeting was called to order by Vice Chairman Tom McGlynn.  Those present were Tom McGlynn, Randy Heims, Gilman Moe, Harriet Pedley, Sherry Dobbs and Harriet Pedley.  Chairman Larry Sebranek and Allen Rippchien were absent.

 

Item #2            Pedley stated the agenda was published in the Richland Observer for two weeks and was posted on the bulletin board in the courthouse.  Motion by Moe, seconded by Heims to approve the agenda and publication.  Motion carried.

 

Item #3            Motion by Heims, seconded by Moe to approve the minutes of the July 2, 2009 meeting minutes.  Motion carried.

 

Item #4            The board heard a petition from Sherry Dobbs to request a variance to the requirement of one dwelling on a parcel to two dwellings on a parcel in Section 6 of Forest Township.  Dobbs explained that she has purchased her parents farm and the house on the farm is still occupied by her parents.  Her family has owned and operated this farm for many years.  Her brother owns an adjoining farm and Dobbs may be purchasing 20 acres from him to help him out financially.  All of the existing dwellings on both farms are off of Albeit Lane, a dead end town road.  Dobbs would like to build a home for herself having the driveway enter on Albeit Lane and not State Hwy 131.  She has done some study as to where the best place for a new driveway on Albeit Lane would be so as not to create a hazard with all the farm machinery.  Heims asked where, according to the provided photo, the parents live.  Dobbs stated she went to the town board meeting where it was suggested that if the driveway would need a tube installed that they, the Dobbs, take care of that.  Pedley read the list of neighbors notified and stated none were heard from.  After all the members reviewed the packet of information a motion by Moe, seconded by Heims was made to approve the request for a second dwelling.  Motion carried. All members voted for the same reasons.

 

Item #5            Pedley reported to the board members concerning the status of Vodak vs. RC Board of Adjustment Case #08-CV-203.  She has spoken with the county attorney and he related that as far as he is aware, the State Court of Appeals has not asked for a copy of the record to date.  Pedley stated she would continue putting this on the agenda and keep the board members informed. 

 

Item #6            Pedley reported to the board members that the resolution concerning amending the county board rule concerning term limits was successful at the last county board session.  The board of adjustment members will no longer be required to leave their position on the board after six years.  There will be a resolution at the next county board session concerning the changes to the term limits of the existing members as follows:

 

 

 

Randy Heims – July 1, 2007 to July 1, 2010

Tom McGlynn – July 1, 2008 to July 1, 2011

Larry Sebranek – July 1, 2008 to July 1, 2011

Gilman Moe – July 1, 2009 to July 1, 2012

 

Since Rippchien is absent today Pedley will call him and inquire if he wants to remain an alternate or take a full membership.  We still need two more members and Pedley is still working on finding interested candidates.

 

Item #7            Pedley reported 3 petitions for the September meeting and possibly one more to come in.

 

Item #8            Motion by Heims, seconded by Moe to adjourn.  Motion carried.
