Minute of the Richland Board of Adjustments Committee Meeting

Thursday, October 6, 2011

 

Item # 1        The Board of Adjustments committee meeting was called to order by Chairman Sebranek at 12:57 pm. Those present or who signed up to speak were Randy Heims, Allen Rippchen, Tom McGlynn, Larry Sebranek, Steve Rosenbeck from McMahon, Paul Theobald from The Probst Group, Mike Malmstead from Schreiber Foods, Jim Wittenberger from Foremost, Michael Bindl and Cheryl Dull taking minutes.

 

Item #2         Motion by Randy, seconded by Allen, to approve the publication and agenda. Motion carried.

 

Item #3         Moved by Larry to declare the minutes approved as presented.

Item #5         The committee heard a petition for Ray & Sylvia Schmitz and Renewable Energy LLC to request a Special exception to grade more than 2000 sq ft of the Pine River on slopes less than 12% per Shoreland Ordinance in Section 28 of Richland Township

 

Discussion: Steve Rosenbeck presented that the application is for grading an excess of 2000 sq ft totaling of 1.5 acres. Disturbance will be for the force main and driveway entrance for the project. Water from the driveway will be diverted to a pond on site which will then discharge to the Pine River to meet DNR requirements. Some of the disturbance will be for the farmer so he can farm the maximum land available. The north side of the disturbance is for force main. They will bore under the river and install 8” & 12” pipes of which the 12” will be were all the plants join together. 60000 sq ft of the disturbance will be the driveway. The farm field will drain as it currently has done through 2 culvers at 15” x 21”. They will not impact floodplain with their work although as they have pointed out the building is in a portion of the floodplain. When they did the plans they looked at the floodplain, FEMA regulation aspects and also a hydraulic model. Randy questioned if all the regulations had been looked at and Mike informed the committee that they had. There will also be a 24” end fall from the ponds for the plants.

Motion by Allen, seconded by Randy to approve the petition, with all members reviewing the same materials and voting for the same reasons. Motion carried.

 

Item #4:        Larry does not want to be nominated as Chair for the next term. It was decided verbal ballot would be used. Motion by Allen to nominate Randy to be Chair, seconded by Tom. Unanimous ballot was cast for Randy. Motion carried. Motion by Allen to nominate Tom as Vice Chair, seconded by Randy. Unanimous ballot was cast for Tom. Motion carried.

 

Item #7         Mike reported there has been an application filed for a variance for someone to build a garage within 70’ of the centerline to a 50’ setback.

 

Item #8         Next meeting is set for November 3 at 1:00 pm. Motion to adjourn by Allen, seconded by Tom. Motion carried.
