Zoning Committee Meeting Minutes

April 7, 2008

 

Item #1  The zoning committee meeting was called to order by Chairman Rasmussen at 9:00 a.m.  Those present were Richard Rasmussen, Betty Havlik, Carol Clausius, Marilyn Marshall, Harriet Pedley, Lyall Barnes, Verlin Coy, Gerald Granger, Travis Morris, Catie Brunson, Dennis Steven Baley, Michael Baley, Rebecca Hooks, Tony Augelli, and Scott Banker.

 

Item #2  Pedley stated that the meeting was properly posted in the Richland Observer and the courthouse.  Motion by Havlic, seconded by Clausius to approve the publication and agenda.  Motion carried. 

 

Item #3  Motion by Havlik, seconded by Clausius to approve the March 3, 2008 meeting minutes as presented.  Motion carried.

 

Item #4  The committee heard a petition from Lyall Barnes to rezone 12 acres from Agriculture/Forestry to Agriculture/Residential in Section 7 of Marshall Township.  Rasmussen read the petition and the committee reviewed the packet of information provided by Pedley.  Barnes explained to the committee that he is selling 41.46 acres to his neighbors, Lovell Investments, and retaining the house and 12 acres that will also go up for sale since they now live in Viroqua.  Lovell Investments were not interested in purchasing the buildings.  Pedley provided the committee with a map showing the 2 acres that encompass the house a few out buildings that are east of Patch Hill Road and another 10 acres west of the road that make the 12 acres to be rezoned.  Barnes has received approval from Marshall Township and there were no neighbors heard from.  Motion by Clausius, seconded by Marshall to approve the rezoning request and pass it to the next county board session.  Motion carried.

 

Item #5  The committee heard a petition from Jeffrey A. & Pamela Coy, owners and Phil Lindsey, buyer to rezone approximately 6.3 acres from Agriculture/Forestry to Agriculture/Residential in Section 24 of Henrietta Township.  Rasmussen read the petition and the committee reviewed the packet of information provided by Pedley.  On the survey provided, it shows a sixty six foot wide area coming off Soules Creek Rd instead of the whole lot area going to the centerline.  The reason the Coy’s did that was to preserve as much farm ground as possible and leave it zoned agriculture.  On the map that was created by the zoning office, it shows that this area is mapped as prime farmland.  Coy had previously put a small one room cabin on this land and Lindsey had used this property in the past for hunting.  He now wants to purchase the cabin.  Pedley stated that no neighbors were heard from and the township approved the request.  Motion by Clausius, seconded by Havlik to approve the rezone and pass it to the next county board session.  Motion carried.

 

Item #6  The committee heard a petition from Gerald & Belinda Granger, owners, and Travis Morris & Catie Brunson, buyers, to rezone 5.63 acres from Agriculture/Residential to Residential-1 in Section 13 of Dayton Township and obtain a conditional use permit for a multi-family dwelling.  Pedley stated that this property was previously rezoned to Agriculture/Residential along with the parcel next to it in 2006.  At that time, Granger stated that he was going to sell this property.  The proposed buyers want to put a multi-family dwelling on it so therefore, the correct zoning district would be Residential-1 with a conditional use permit.  This parcel will share a driveway that connects to State Hwy 14.  The building site will be closer to the road where the slope is less severe.  Brunson and Morris plan on living in one side of the home.  Gallagher, a neighbor, called and stated she would prefer to see a single family dwelling there.  The township approved the request.  Motion by Havlik, seconded by Clausius to approve the rezone and pass it to the next county board session.  Motion carried.

 

Item #7   The committee heard a petition from Dennis Steven Baley, owner, and Michael Baley, buyer, to rezone approximately 2 acres from Agriculture/Forestry to Residential-2 in Section 27 of Westford Township.  Rasmussen read the petition and the committee reviewed the packet of information provided by Pedley.  As part of the packet, a map showing the proposed building site of a home owned by Michael Baley, nephew of Dennis Baley was provided.  The 2 acres are positioned on the Baley farm at the end of a field road about 1,300 feet from County Hwy NN.  The existing field road would have to be continued another estimated 500 feet to the building site.  Pedley stated a soil test was completed last week and a site for a mound was found.  Pedley stated that no neighbors were heard from and Westford Township approved the request.  Motion by Clausius, seconded by Havlik to approve the rezoning request and pass it to the next county board session.

 

Item #8   The committee heard a petition from Benjamin Hooks, buyer and Don Stowell, owner, to rezone approximately 2 acres from Agriculture/Forestry To Residenti-2 in Section 7 of  Henrietta Township.   Rasmussen read the petition and the committee reviewed the packet provided by Pedley.  Pedley explained that Hooks and Stowell were at last month’s meeting and wanted to rezone 8 acres.  At that meeting, Hooks told the committee that they had changed their mind and did not want to rezone 8 acres to Agriculture/Forestry but 2 acres to Residential-2.  It was decided at that time that they should re-file the petition and the zoning office should re-post the request.  Rebecca Hooks provided a survey showing the 2 acres proposed.  The lot would be in the same position only smaller.  Pedley stated that there was a neighbor previously opposed to the rezoning and called again and said that the smaller parcel was more to his liking.  Hooks stated she talked with the neighbor also and she stated that the neighbor did not realize that she was the granddaughter of the farm owner.  The snowmobile trail that is shown on the survey will be relocated.  Motion by Marshall, seconded by Clausius to approve the rezone request and pass it to the next county board session.  Motion carried.

 

Item #9  The committee heard a petition from Tony & Kathie Augelli, buyers, and Tom Hauber, seller to obtain a Conditional Use Permit to place a maintenance facility, storage units and office rental space in Section 1 Orion Township on property that is presently zoned Commercial.  Rasmussen read the petition and the committee reviewed the packet of information.  Pedley provided the committee with a copy of the site map that Augelli had created.  On the drawing it shows a proposed 48’ X 30’ office space to be used by the Augelli business dealing with concrete construction and snow removal, a 48’ X 60’ shop area to be used for the Augelli business, a 20’ X 48’ rented shop area, a 16’ X 48’ salt storage shed, and two mini storage sheds, one 24’ X 175’ and one 75’ X 24’.  There is an existing shed 36’ X 26’.  The existing septic system has failed and a new mound system will be installed to service the office facilities and any other wastewater use on the lot.  Augelli stated that the rented office space may happen in the future.  The salt shed will be constructed with 8’ high concrete walls and a concrete floor with a tin roof.  The area for rental purposes in the large shed may be rented to people who have recreational vehicles or other large objects.  Pedley discussed the setback issued with Augelli stating that structures need to be 150 feet from the centerline or 70 feet from the road right of way, whichever is greater.  Augelli has received approval from the town and no neighbors were heard from.  Motion by Havlik, seconded by Clausius to approve the Conditional Use Permit with the following conditions:

 

1.      Structures on the property are to be used for the Augelli business of concrete construction and/or their snow plowing business.  The shop shall be used for construction equipment and/or plowing equipment.

2.      Structures to be built will be a 48 foot by 30 foot office space attached to a 60 foot by 50 foot shop area that includes a 20 foot by 50 foot area designated as the area proposed for rental space.  A portion of the office space may be used as rental space.   A separate structure to be used as a salt shed will be 16 foot by 48 foot with 8 foot concrete walls on three sides with a concrete floor and a metal roof.  (This structure may need state approval.  It will be the responsibility of the property owner to obtain any necessary permits for this structure.)  Two mini storage units, one being 24 feet by 175 feet and one being 75 feet by 24 feet.  The existing lighting for the larger storage units may be sufficient but additional lighting shall be installed if necessary for the smaller unit.

3.      The area shall be sloped per the drawing supplied to assist in erosion control.

4.      All other state and federal permits necessary shall be obtained by the property owner and a copy supplied to the zoning office in a timely manner.

Motion carried.

 

Item #10  A rezoning request was reviewed by the committee from Rockbridge Township.  The town has approved a rezoning for John Jansen to rezone 3 acres to their Commercial District.  Mr. Jansen runs a foam insulation business on County Hwy BR.  Scott Banker, the Town Chairman and Zoning Administrator stated that this request has been approved by the town planning commission and the town board.  Motion by  Clausius, seconded by Havlik to pass this rezoning request to the next county board session. 

 

Item #11  This item is tabled until the next meeting or a special meeting of the zoning committee.

 

Item #12  Pedley explained that the Department of Commerce is proposing to increase their fees retained from every sanitary permit issued by the counties to $100.00.  This is a $25.00 increase.  Pedley stated that the county has the choice of raising our own fee of $300.00 to $325.00 to cover this increase or take $25.00 less for every permit.  She stated that the last time the state increased their fee was 1992.  Discussion followed and a motion by Havlik, second by Clausius to approve a $25.00 increase for any state sanitary permit issued by the county whenever the Wisconsin State Legislature approves the increase.

 

Item #13  Pedley reported that the Melanie Johnson home on State Hwy 80 just north of the City of Richland Center has provided the zoning office with engineered plans to raise the home on their property above the regional flood elevation.  Pedley explained to the committee that this home is mapped in the floodfringe of the Pine River and received more than 50% damages in the August flood event.  They have a choice of either raising the structure to the flood protection level or removing the structure.   The garage on the Dave Bee property has received additional damage from the heavy snow and since he is mapped in the floodway of the Pine River, he will not be able to replace it.  After some discussions with the DNR, Bee will be able to build an open sided, roofed structure to store his belongings in.  

 

Item #14  Zoning Violations:  Pedley provided the committee with photos of the McBain property in Willow Township.  There had been a complaint filed to the office about an unlicensed junk yard there.  Pedley has reported this property to the Health & Human Service offices and Troy Morris has inspected the property but no report has been filed with the zoning office to date.  The committee instructed Pedley to continue with violation procedures.

 

Item #15   Report:

a.       The fees for the second Hooks petition are not necessary

b.      Motion by Clausius, second by Marshall to approve the 2007 Annual Report and pass it to the next county board session.

c.       Pedley reported that Mary Storms has left the employment of the zoning office and has taken a position as the Deputy Clerk of Court.  Options for the zoning office were discussed and Pedley has posted the position with the union, receiving no takers and has now posted the position in both newspapers and on the county website and the website of Wisconsin County Code Administrators.  She has received two inquiries so far.

d.      Pedley thanked Betty Havlik for her six years of service on the zoning committee.

 

Item #16  The next regular meeting is set for May 5, 2008 at 9:00 a.m.  Motion by Marshall, second by Havlik to adjourn.  Motion carried.
