ZONING COMMITTEE MEETING MINUTES

January 3, 2005

 

Item #1            The zoning committee meeting was called to order by Chairman Rasmussen at 9:00 a.m.  In attendance were Richard Rasmussen, Marilyn Marshall, Bruce Wunnicke, Carol Clausius, Betty Havlik, Harriet Pedley, Mary Storms, LaVon Williams, Greg Marcus from the DNR, Ray Starnes, and Buford Edgerly.

 

Item #2            Motion by Havlik, seconded by Marshall to approve the amended agenda and publication.  Motion carried.

 

Item #3            Motion by Marshall, seconded by Clausius to approve the minutes of December 6, 2004.  Motion carried.

Item #4            Motion by Havlik, seconded by Clausius to bring the petition of LaVon & Judith Williams to rezone 25 acres from Agriculture/Forestry to Agriculture/Residential in Section 31 of Orion Township off the table.  Williams would like to sell off 51 acres from the 77 acres that he owns.  Pedley stated that a farm consolidation was not a possibility as Williams is keeping too many acres.  Pedley also stated that after looking at the site and the maps there is a possibility of wetlands being on the property that would affect new building sites.  Pedley stated that she has discussed with Williams some of the alternatives of rezoning -  one being that he could rezone 5 acres in one district and the remaining 20 acres in another district.  Williams stated he would just as soon not have his property in two different zoning districts.  Wunnicke wondered if it could possibly stay zoned Agriculture/Forestry and have Williams request a variance to parcel size from the Board of Adjustments.  Rasmussen brought up the fact that tax consequences could be quite different going from Agriculture/Forestry to Agriculture/Residential.  Williams stated he had no objection trying to go for a variance to parcel size.  Motion by Wunnicke, seconded by Clausius to table the Williams petition to see if the Board of Adjustments granted a variance to parcel size.  Motion carried.

 

Item #5            The committee heard the petition of Andrew Konopacki, seller, Tammy Gzibovskis, buyer, to rezone 10.14 acres from Agriculture/Forestry to Agriculture/Residential in Section 13 of Dayton Township.   Ray Starnes, the real estate agent for Andrew Konopack, explained to the committee that Tammy Gzibovskis and Buford Edgerly have an offer in on the property and plan on building on the parcel.  The driveway has been approved by the Department of Transportation and a tube is already in place.  Starnes stated that the parcel can not be divided down any further than what the CSM shows as Konopacki has sold 7 acres to Knapp/Granger so a failed septic system could be replaced.  Starnes also stated that there are currently no buildings on the site but there is power already there.  The Town of Dayton thought it was okay and had no objection. Discussion with the committee and Starnes showed that the driveway permit supplied was incorrect and the correct permit needs to be supplied.  Motion by Havlik, seconded by Wunnicke, to approve the petition with the correct driveway permit from the Department of Transportation.  Motion carried.  Petition will go before the next county board meeting which is January 18, 2005

 

Item #6            The committee heard the petition from the Department of Natural Resources, Greg Marcus, who is the real estate specialist with the DNR to rezone approximately 2 acres from Agriculture/Forestry to Residential-2 in Section 21 of Forest Township.  The DNR purchased 159 in the Camp Creek area and need to rezone approximately 2 acres with the house.  There is an accepted offer on the house.  A driveway that is already there will be shared with the owner and the DNR.  The Town of Forest told the DNR to go talk to Harriet.  A brief discussion followed with the board and the DNR.  Motion by Wunnicke, seconded by Clausius to approve the petition from the DNR to rezone approximately 2 acres from Agriculture/Forestry to Residential-2 in Section 21 of Forest Township and pass it to the next county board session.  Motion carried.

Item #7            Amendment to Richland County Zoning Ordinance #5 concerning foundation/basements – the wording of foundations/basements have been removed in all zoning districts except 2.  Motion by Wunnicke, seconded by Marshall to approve the amendment changes presented by Pedley and present it to the county board.  Motion carried.

                        A motion by Wunnicke, seconded by Havlik to direct Attorney Southwick to prepare the printing of the ordinance.  Motion carried.

 

 

Item #8            Friends of Richland County vs. Richland County – Pedley stated that Friends lawsuit have dropped all but 3 rezonings – Goebel, Schmitz and Clark.  Attorney Yde thinks that these 3 were chosen because they had the least amount of discussion before they were approved.  Pedley will keep the committee advised as to the standing of the lawsuit.  Wunnicke asked if he could review current paperwork that Pedley has received.

 

Item #9            Comprehensive Planning – Pedley stated that she will check with Ron Niemann of Southwest Regional Planning what date and time has been set up for the next meeting with the committee.  Havlik stated she has written in her appointment book February 2 at 7:00 p.m.  Pedley will advise the committee of what she finds out.

 

 Item #10         Zoning Violations – Pedley stated that all she had to report was Eagle Cave.  They did have a dead line of December 1, 2004 to get a soil test done which has come and gone.  The Hanke’s did contact Duane Steiner from the state to come to their property to discuss the soil test and he informed them they need to get the soil test done as soon as possible.  Pedley also stated she has been trying to contact the Hanke’s son, Rick, in regards to the paint ball court, which has not been cleaned up as of today’s date. 

           

Item #11          Report from zoning administrator – Pedley asked if the committee wanted anything prepared for county board regarding the Johnson petition (bar) or the amendments that were discussed in Item 7.  Discussion followed regarding the bar that if it does pass county board it will need to come back to the zoning committee to get the conditional use permit approved. 

                        Pedley also stated that the office is now working on getting the non-metallic mining reports completed.  She and Kenny Anderson have been doing on site inspections of the quarries.  The Town of Akan is the only one we are waiting on. 

Pedley also state that the office is starting work on the flood plain management to

amend the flood plain ordinance. 

                        Pedley stated that to date she has a petition to rezone 4 lots in Akan Township for Secluded Land for next months meeting.

 

Item #12          The next regular meeting will be held on February 7, 2005 at 9:00 a.m.  Motion by Havlik, seconded by Clausius to adjourn.
