ZONING COMMITTEE MEETING MINUTES

July 6, 2005

 

Item #1            The zoning committee meeting was called to order by Chairman Rasmussen at 1:00 p.m.  In attendance were Richard Rasmussen, Marilyn Marshall, Carol Clausius, Betty Havlik, Bruce Wunnicke, Harriet Pedley, Mary Storms, Steve Kohlstedt, Hank Maslach, Don Heindl, Chuck Perkins, Paul Perkins and Joni Herren.

 

Item #2            Motion by Marshall, seconded by Havlik to approve the agenda and publication.  Motion carried.

 

Item #3            Rasmussen asked if there were any additions or changes to either the minutes of the June 1, 2005 comprehensive Planning meeting or the June 6, 2005 Zoning meeting as mailed.  Hearing none, Rasmussen stated the minutes of both meetings were approved as mailed.

Item #4            The committee heard the petition of Paul & Charles Perkins to rezone 5.10 acres from Agriculture/Forestry to Agriculture/Residential in Section 10 of Dayton Township.  Pedley provided the committee with Certified Survey Maps showing the proposed boundaries and explained to the committee how this proposal affects the previous rezone for Dennis Perkins.  This rezoning request will take a portion of the acreage that Paul Perkins will own and also some acreage from the seven acres that was approved by the county at the last session.  Perkins explained to the committee that he plans on building a home in the area where the shed is located.  Charles and Paul Perkins stated that there will be 5 divisions of the original farm with one existing house and two new homes.  Wunnicke stated he drove out to the area and is not comfortable putting another house there when we have already rezoned for two homes.  Perkins stated he has been to the township and they have approved his driveway permit.  Discussion between the board members and Perkins followed.  Marshall stated that as long as it was family she was in favor of allowing the rezone.  Pedley stated that the office sent notice to 10 neighbors and did not hear from any of them.  Wunnicke made the motion to deny the request, seconded by Rasmussen.  Rasmussen called for a roll call vote.  Marshall & Clausius voted no, Wunnicke, Rasmussen and Havlik voted aye.  Motion carried.  Rezone request was denied.  Pedley then stated the petition will need to go to the county board as a denied petition.  County board is scheduled to meet July 19th at 7:00 p.m.

 

Item #5            Motion by Havlik, seconded by Rasmussen to bring the Maslach petition off the table.  Motion carried.  Maslach again stated that he would like to rezone approximately 10 to 13 acres where the improvements are and keep it for him.  His intention is to remove the mobile home and build a home there sometime in the future.  He has the balance of his 100 acres in forestry and crop reduction programs.  It is up for sale at this time.  If the 100 acres doesn’t sell he will be keeping it and will build anyway.  Maslach stated he talked to the assessor, Gretchen Jelinek, and she stated that she assesses an acre around the house as residential and then the balance is based on use.  She advised Maslach that zoning and assessment are really two different things.  Motion by Wunnicke, seconded by Clausius to approve the rezoning of 10 to 13 acres from Agriculture/Forestry to Agriculture/Residential in Section 12 of Richland Township.  Motion carried.  

 

Item #6            Motion by Clausius, seconded by Marshall to bring the Burnham petition off the table.  Pedley stated she had received a call from Burnham to withdraw his petition.  Petition withdrawn.

Item #7            Comprehensive Planning -  Kohlstedt went over the transportation element.  A survey was sent out to various citizens of Richland County and asked to rate different aspects of transportation.  Safety was the number one concern, connectivity with the larger transportation system second.  There was discussion between the board, Kohlstedt and Joni Herren from SWWRPC.  Herren stated that she will assist in the writing of this element but the ideas have to come from the county.  Kohlstedt then went through some of the questions in the packet to get input from the committee concerning their priorities.  The committee will finish the questions on their own and will go over them at the August 9th meeting.      

 

Item #8            Friends of Richland County vs Richland County – Pedley stated there is nothing new to report.

 

Item #9            Reclassification of Zoning Administrator – Pedley asked the board to be reclassed.  The reclassification would increase the budget by $2,194.  This increase could be made up by increasing the sanitary permit and soil test filing report fees.  These fees have not been increase for a few years.  Pedley handed out a sheet showing the different rates for sanitary permits in the area.  Richland County fees rank about in the middle.  Wunnicke stated that with the additional work of Comprehensive Planning and administrating the flood plain that he saw no reason that the reclassification shouldn’t be approved.    Motion by Wunnicke, seconded by Clausius to approve the reclassification at the job rate of $20.60 and send it to the Personnel Committee.   Motion carried.

 

Item #10          Zoning Violation – Palmer/Heindl glass blowing in Willow Township – Heindle stated he received a letter from Pedley about his glass blowing business and orchard.  He stated that they have planted a few apple trees but by no means plan on an orchard.  He also stated that his son is an artisan and does work for a glass blower in Spring Green.  His son does not run a business out of their property.  Heindle stated that his son has only fired up the furnace once this summer as it is so expensive.  Pedley stated that the only reason she brought this to the committee was the township wondered if a conditional use permit is required.  The committee agreed that no conditional use permit is required at this time. 

 

Item #11          Report from Zoning Administrator -   Pedley stated that Weglarz from Weggy Winery, called her a day or so after the committee had issued the conditional use permit for his signs which were to be a maximum of 36 inches x 12 inches.  At the time of the meeting he already had two signs that were 48 inches x 12 inches.  He is requesting that he be allowed to use these two signs.  A brief discussion among the board members followed.  Motion by Havlik, seconded by Clausius to amend the conditional use permit to allow the 2 signs 48 inches x 12 inches as part of the 8 approved signs.

 

Item #1            The next regular meeting will be held on August 8, 2005 at 9:00 a.m.  Motion by Wunnicke, seconded by Clausius to adjourn.  Motion carried.
